MasterShield® Producer Successfully Enforces its Micromesh Gutter Guard Patent Against Competitor
Paramus, NJ (PRWEB) July 17, 2013 -- The US District Court for the Northern District of California issued an Order and Judgment in Case No.: 2:13-cv-000849 that Shingle Springs, CA-based company Your Last Gutter Guard committed multiple acts of infringement on several MGP Manufacturing LLC patents for a microfiltration or micromesh gutter guard. MGP produces MasterShield® Gutter Protection.
Defendant Your Last Gutter Guard (“YLGG”) manufactured and offered for sale a micromesh gutter guard utilizing MGP’s micromesh technology.
Under the terms of the Order, YLGG acknowledged that inventor Edward A. Higginbotham and MGP have expended a great deal of time, effort and resources developing its product MasterShield® and its related patents, including U.S. Patent No. 8,397,436, RE42,896 and RE43,555 (collectively, the “MGP Patents”).
YLGG also acknowledged that the Your Last Gutter Guard product infringed the MGP Patents and that the MGP Patents are valid and enforceable. YLGG further acknowledged that the inventions claimed in the MGP Patents (1) have met with commercial success; (2) resolved long felt, but unresolved need; (3) overcame the failure of others; (4) was initially met with skepticism by industry experts; (5) was ultimately praised by others in the industry; (6) was a departure from the teachings of others; (7) recognized a problem in the field of art; and (8) has been copied by competitors in the industry. Pursuant to the Order, YLGG has stopped selling the Your Last Gutter Guard product and has exited the gutter guard manufacturing business.
