McEldrew Young Releases Video Commenting on Auto Whistleblower Bill
Philadelphia, PA (PRWEB) February 13, 2015 -- McEldrew Young, a Philadelphia law firm representing whistleblowers, has released a video on U.S. Senate Bill S. 304, the Thune-Nelson Motor Vehicle Safety Whistleblower Act. It was originally introduced last Congress on November 20, 2014 as S. 2949. Eric L. Young, Esq., a Partner at McEldrew Young, discusses the components of the bill in the eight minute video and suggests three improvements to encourage more auto whistleblowers to come forward.
“The auto industry has been accused of putting millions of families at risk by delaying recalls and failing to report safety data to the government,” stated Young. “Incentivizing whistleblowers in the auto industry could help the government protect American families from unsafe vehicles in the same way that Dodd-Frank protects investors and the False Claims Act protects the public fisc.”
As currently written, the bill provides the Secretary of Transportation the discretion to offer employees of automobile manufacturers, parts suppliers and dealerships rewards of up to 30 percent of penalties when the Department of Justice or Department of Transportation collects more than $1 million. It does not contain anti-retaliation measures to protect them in case of retaliation for providing the government information.
According to Young, the legislation would be substantially improved by expanding eligibility for awards beyond the categories of insiders listed in the bill, moving from discretionary to mandatory rewards and offering anti-retaliation protections to individuals who come forward.
“The Thune-Nelson bill is a step in the right direction,” commented Young. “A few changes could make it a powerful tool in the government’s arsenal against corporate misconduct.”
