Mesh Lawsuit – Bellwether Cases Selected in Federal Litigation Underway for Ethicon Transvaginal Mesh Lawsuits, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) July 28, 2013 -- Mesh lawsuit claims involving transvaginal mesh products marketed by Johnson & Johnson’s Ethicon, Inc. unit continue to move forward in a multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to an Order issued on July 25th, the Court has designated four Ethicon transvaginal mesh lawsuits for the proceedings’ first two rounds of bellwether trials. The first round of trials is scheduled to begin on January 14, 2014, while the second will commence on May 27, 2014. Ethicon Mesh Lawsuits
Court documents indicate that more than 8,460 transvaginal mesh lawsuits have been filed in the federal proceeding underway in West Virginia. All of the claims pending in the litigation allege that Ethicon failed to provide adequate warnings regarding the risks associated with Gynecare pelvic mesh products used to treat pelvic organ prolapse and stress urinary incontinence. It is further alleged that plaintiffs suffered a variety of serious complications due to the defective nature of these products, including chronic infections, organ damage, and mesh erosion and shrinkage.
Transvaginal mesh devices and related complications have been the subject of two U.S. Food & Drug Administration (FDA) Public Safety Alerts since October 2008.* While Ethicon has never announced a mesh recall for any of the Gynecare products involved in the litigation, the company did announce in June 2012 that it would stop sales of some of those device due to commercial concerns.**
Ethicon is just one of several pelvic mesh manufacturers facing litigation over these devices in the Southern District of West Virginia. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is also serving on the Plaintiffs’ Steering Committees for proceedings involving American Medical Systems, Inc. (MDL No. 2325) Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187). Court documents show that the first of the litigations’ bellwether trials, involving a C.R. Bard product, is scheduled to begin on July 29, 2013.
Mr. Grand has also been named Co-Liaison Counsel in two consolidated litigations established for C.R. Bard and Ethicon transvaginal mesh lawsuits that are currently underway in New Jersey’s Atlantic County Superior Court. He was also a member of the trial team on the first Ethicon trial in that proceeding, which ended in March with an $11 million verdict for the Plaintiff.
