Mirena IUD Lawsuits Move Forward, With Issuance of New Case Management Orders in New Jersey Litigation, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) September 28, 2013 -- More than 200 Mirena IUD lawsuit (http://www.themirenalawsuitcenter.com/) claims filed on behalf of young women who allegedly sustained serious injures due to spontaneous migration of the device continue to move forward in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to court documents, a number of Case Management Orders were issued in the multicounty litigation on September 25th, which pertained to the use of a Defense Fact Sheet; the preservation of documents and electronically stored information; the protocol for document format production; and a discovery schedule.

Court documents indicate that more than 370 Mirena lawsuits are now pending in litigations underway in both federal and state courts. In addition to the 219 claims that have been filed in New Jersey, 159 Mirena IUD lawsuits involving similar allegations are also pending in a federal multidistrict litigation underway in U.S. District Court, Southern District of New York. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434) All of the claims accuse Bayer Healthcare Pharmaceuticals of failing to provide adequate warnings regarding the possibility of spontaneous migration and related complications, and of exaggerating Mirena’s benefits while downplaying its risks. Some of the Mirena complications allegedly suffered by these plaintiffs include uterine perforations, uterine embedment, ectopic pregnancy, infections, and scarring.
Recent media reports indicate that the U.S. Food & Drug Administration (FDA) has received more than 70,000 complaints involving Mirena complications, including instances of device dislocation and uterine perforation, since the IUD was first approved by the agency as a long-action method of birth control in 2000.* In 2009, Bayer received an FDA Warning Letter which criticized the company for making claims in certain Mirena marketing materials that the agency deemed to be misleading, including some that overstated the IUD’s benefits and downplayed serious Mirena complications.
