Mirena Lawsuit News: Bernstein Liebhard LLP Notes Upcoming Status Conference in Federal Mirena Litigation
New York, New York (PRWEB) January 21, 2014 -- Hundreds of Mirena lawsuits (http://www.themirenalawsuitcenter.com) pending in a multidistrict litigation now underway in U.S. District Court, Southern District of New York, are continuing to move forward, Bernstein Liebhard LLP reports. According to documents filed in the proceeding, the Court will convene a Status Conference on January 22, 2014. At that time, it is expected that the Court will address two Motions to Dismiss that are expected to be filed in the near future by Bayer Healthcare Pharmaceuticals. One of the motions involves certain Mirena IUD lawsuits which Bayer claims were filed after the statute of limitations expired. Mirena IUD Lawsuits
The Mirena IUD was brought to market in 2000 as a contraceptive device. In 2009, its approved uses were expanded to include the treatment of heavy menstrual bleeding in women who wished to use an IUD as their primary method of birth control. Bayer received a Warning Letter from the U.S. Food & Drug Administration in 2009, after the agency determined that one of its Mirena promotions made misleading claims involving the benefits associated with the device, and downplayed the risk of serious Mirena complications.
Court documents indicate that at least 344 lawsuits have been filed in the Southern District of New York on behalf of women who allegedly suffered serious Mirena complications. Among other things, the Mirena lawsuits claim that the product’s label lacks a warning regarding its potential to spontaneously migrate after the IUD has been properly inserted by a doctor. Rather, plaintiffs point out that the label only cautions that this type of Mirena migration may occur if the uterus is perforated during insertion.
In addition to the Mirena IUD lawsuits filed in the federal proceeding, court records show that at least 488 additional claims involving similar allegations are also pending in a multicounty litigation now underway in New Jersey’s Bergen County Superior Court.
