According to a Case Management Order issued on September 23, 2014, Defendants must, on a monthly basis, provide Plaintiffs with a list of cases for which Plaintiff’s Fact Sheets have not been filed in a timely fashion, and for which Defendants plan to file a Motion to Dismiss. The Order further stipulates that Plaintiffs must file the Fact Sheet or request an extension from the Court at least two days prior to the Motion Filing Date. The Mirena IUD is a long-acting contraceptive that was initially approved by the U.S. Food & Drug Administration (FDA) in 2000. In 2009, the FDA also approved Mirena for the prevention of heavy menstrual bleeding in women who wish to use an IUD as their primary method of birth control. That same year, the FDA issued a Warning Letter to Bayer after finding that one of the company’s Mirena promotions made misleading claims about the safety and efficacy of the IUD.
Court documents indicate that at least 1,093 Mirena IUD lawsuits are now pending the litigation underway in Bergen County Superior Court. All of the complaints allege that Bayer Healthcare Pharmaceuticals failed to warn that spontaneous IUD migration may occur after Mirena has been correctly inserted into the uterus by a healthcare provider. The lawsuits further claim that this occurrence caused Plaintiffs to experience a number of serious and painful Mirena complications, including uterine perforations, scarring, adhesions, infections and organ damage.
According to court records, an additional 937 complaints involving similar allegations have been filed in a federal multidistrict litigation underway in U.S. District Court, Southern District of New York. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)
