Court records indicate that more than 1,600 Mirena IUD lawsuits have been filed in the litigation underway in New Jersey. According to Bernstein Liebhard LLP, the proceeding was created on May 13, 2013 by an order of the New Jersey Supreme Court, which designated all pending and future litigation involving the IUD for centralized management in Bergen County Superior Court. All of the claims pending before the Court allege that Bayer Healthcare Pharmaceuticals failed to warn that the Mirena IUD could migrate weeks, months and even years after proper insertion in the uterus, resulting in uterine perforations and other serious complications. Among other things, the lawsuits point out that the Mirena labeling only warns that migration might occur if the uterus is perforated during the insertion procedure.
In addition to the claims filed in New Jersey, court documents show that more than 1,100 Mirena lawsuits have been filed in a federal multidistrict litigation now underway in U.S. District Court, Southern District of New York.
