More Than 430 Cases Now Filed in Federal GranuFlo Lawsuit Litigation, Bernstein Liebhard LLP Continues to Investigate Dialysis Claims
New York, NY (PRWEB) December 22, 2013 -- GranuFlo lawsuit (http://www.thegranuflolawsuit.com/) claims continued to be filed this month in a federal litigation that now includes more than 430 cases over the recalled dialysis medications, according to Bernstein Liebhard LLP.
As per a Case List updated December 16th by the U.S. Judicial Panel on Multidistrict Litigation (JPML), a total of 433 lawsuits are now pending in in the U.S. District Court, District of Massachusetts. Cases filed in this federal proceeding similarly allege that heart attacks, strokes, sudden cardiac arrest and other life-threatening heart problems may result from use of GranuFlo and NaturaLyte, two acid concentrates manufactured by Fresenius Medical Care. Side effects from these drugs, which were used during dialysis treatments, generally occur within 72 hours of administration. According to lawsuits, Fresenius allegedly failed to warn about the fatal and near-fatal risks associated with its products, which were subject to a Class I recall by the U.S. Food and Drug Administration (FDA) in June 2012. GranuFlo Lawsuits
In addition to its growing Case List, the federal Massachusetts litigation is moving forward in other ways as well. Court documents indicate that parties involved in the proceeding have been directed to submit a Case Management Order addressing the process for selecting bellwether trials, as well as case specific discovery, by January 6, 2014.

Claims against Fresenius also point to an internal memo sent by the company in November 2011 that noted 941 patient deaths occurring after use of GranuFlo and NaturaLyte. According to a New York Times report published shortly after the FDA's June 2012 recall of the medications, doctors outside the company’s network were not made aware of their potential to cause strokes, heart attacks and other serious heart problems until March 2012.* At that time, Fresenius issued an Urgent Product Notification that alerted the general public of the risks associated with its products. The Times article states that the FDA had begun investigating whether Fresenius violated federal laws by failing to notify physicians in all U.S. dialysis clinics using GranuFlo and NaturaLyte about the heart problems that may occur after use.
