More Transvaginal Mesh Lawsuits Filed against C.R. Bard and Ethicon in New Jersey, Bernstein Liebhard LLP Reports

Case Lists in both the proceedings, which involve products from C.R. Bard Inc. and the Johnson & Johnson subsidiary, Ethicon, were updated on February 7th to reflect the addition of several new lawsuits alleging chronic pain, pain during sexual intercourse and other complications allegedly caused by the company’s pelvic implants. In the Ethicon proceeding, court documents show 7,622 claims filed, and 1,667 in the C.R. Bard docket. Transvaginal Mesh Lawsuits
In recent years, court documents show that C.R. Bard and Ethicon mesh lawsuits have steadily moved forward in New Jersey’s Bergen County after being filed by women who sustained injuries allegedly due to use of their products. Women in these cases accuse mesh manufacturers of failing to warn about risks associated with their pelvic implants, which may persist even after sometimes numerous removal surgeries.
Jeffrey S. Grand, a partner at Bernstein Liebhard LLP, is currently serving as Co-Liaison Counsel in both the C.R. Bard and Ethicon litigations in New Jersey, the latter of which he also was a member of the Plaintiff’s trial team in a case that concluded in March 2013. The plaintiff in that transvaginal mesh lawsuit was injured by a Gynecare Prolift implant she received, and was awarded $11 million in damages.
Lawsuits against C.R. Bard and Ethicon have also been filed in the U.S. District Court, Southern District of West Virginia, where a number of additional federal multidistrict litigations (MDL) are currently underway and together include more than 70,000. In addition to those involving C.R. Bard and Ethicon, claims against American Medical Systems, Boston Scientific Corp., and other manufacturers have also been centralized in the jurisdiction.
