They will market and distribute accredited harassment courses on Morf Playbook that help companies meet the new standards for the California CA Fair Employment and Housing Act (FEHA) regulations.
On April 1, 2016 harassment training requirements in California got stricter. The new FEHA regulations add to the already lengthy list of compliance requirements for training in terms of process, recordkeeping, and content. Not only do in-house programs need to be better, but trainers are also held to higher standards.
New content requirements in these regulations include:
● Remedies available for victims in civil actions, and potential employer or individual exposure or liability.
● Supervisory obligations to report sexual harassment, discrimination, and retaliation of which they become aware.
● Discussion of strategies to prevent harassment and steps necessary to take appropriate remedial measures to correct harassing behavior.
Company liability for sexual harassment include the following scenarios:
1. If the harassment results in a tangible employment action (hiring, firing, demotion, etc.);
2. If a company is found to be a “hostile work environment” either from a series of minor infractions or from one major one; or
3. If a company knew or should have known about the harassment, without taking immediate and appropriate corrective action.
“I’d love to be able to tell you that companies are less liable than ever...but unfortunately, it just isn’t true,” said Dr. Lynne Curry, HR compliance and harassment training expert and CEO of The Growth Company. “Studies show that from 29% to 50+% of women employees are targets of sexual harassment. And the numbers of men reporting sexual harassment have gone up dramatically. While a majority of these cases go unreported, that doesn’t make liability go away. In fact, it just means that the problem goes underground. In California, an employee has up to a year to report an infraction. A co-worker who witnesses sexual harassment can also report it.”
Probably the most important part of ongoing “corrective action” that can shield a company from liability is excellent ongoing manager training in sexual harassment. In California this is a requirement for all companies with more than 50 employees.
