Tampa, Florida (PRWEB) March 19, 2015 -- A physician who filed a False Claims Act lawsuit* against Adventist Health System, which operates hospitals in Orlando and surrounding areas, will receive $1,082,500 as his share of the recovery in connection with the resolution of allegations that the company provided inappropriate supervision during radiation oncology treatments at its Central Florida facilities, according to the settlement agreement.
Today’s announcement by the Department of Justice marks the end of a two-year government investigation.
According to the settlement agreement, Adventist/Florida Hospital will pay $5,412,502 to resolve the allegations made in a whistleblower qui tam lawsuit filed in January, 2013 by a radiation oncologist who previously worked at the Adventist centers. The lawsuit was filed in the United States District Court for the Middle District of Florida by the Morgan & Morgan Complex Litigation Group. The lawsuit alleged that between 2010 and 2013, the defendants regularly billed for radiation oncology services that were not supervised by an appropriate physician, as required by rules established by the Centers for Medicare and Medicaid Services, according to the complaint.
Whistleblower attorney John Yanchunis, a partner at the Morgan & Morgan Complex Litigation Group who represented the physician, said: “We deeply appreciate the outstanding efforts of the attorneys and investigators in the U.S. Attorney’s Office in the Middle District of Florida, as well as the Department of Justice, who worked on this case and achieved this resolution.” Mr. Yanchunis said further that he was grateful to Orlando based Attorney George Indest of The Health Law Firm, for referring the matter to the firm.
Whistleblower attorney James Young, also a partner with the Morgan & Morgan Complex Litigation Group, added, “Our client is a remarkably courageous physician. Throughout this case his focus has been on protecting patients. As a firm, we are proud to have represented him.”
