Mr. Ticket Owner, Founder Offers Perspective on Reckless Driving During Zombie Walk Trial
Encino, CA (PRWEB) March 25, 2015 -- On Tuesday, March 17, a man who allegedly plowed through a crowd of pedestrians at San Diego Comic-Con's annual "Zombie Walk" last summer pleaded not guilty to a felony reckless driving charge, according to San Diego Channel 6 (March 17, 2015).
Matthew Pocci, 47, has been accused of seriously injuring a woman when he sped through the crowd of several hundred adults, teens and children who were participating in the walk on July 26. If convicted, he faces up to three years in state prison.
San Diego Channel 6 asserts that Pocci had stopped his vehicle two or three car lengths away from the crowd, which was gathered near the intersection of Island and 2nd avenues, and turned his engine off. After a few minutes of waiting, he began to slowly edge into the crowd.
Soon after, Pocci floored his vehicle, striking several people in front of it and virtually running over one woman, who suffered serious injuries to her arm and leg, explains San Diego Channel 6.
Amir Soleimanian, Owner and Founder of Mr. Ticket, a law firm specializing in resolving traffic tickets and reckless driving incidents, says he agrees with Pocci's felony charge. However, Pocci was also right to plead not guilty during his hearing.
"By law, any reckless driving or hit and run that cause bodily harm to anyone should be and is a felony charge," Soleimanian explains. "Pleading not guilty was the right choice for Pocci -- you should always say not guilty in the beginning because down the road when it gets closer to the trial you tend to get a better plea bargain."
Soleimanian says it's important for people to realize that reckless driving doesn't always equate to speeding. A more accurate definition of reckless driving would be any situation in which people are endangered by one's driving.
"People think going too fast is reckless driving, which is not true -- that infraction would result in a speeding ticket," he says. "Not being careful, being reckless and putting other people in danger is reckless driving. Doing donuts with your car in a shopping center when people are all around is reckless and dangerous."
Judge David Szumowski permitted Pocci to remain free until his preliminary hearing, which has been scheduled for May 28, Channel 6 reports.
