Nearly 780 Mirena IUD Lawsuits Now Filed in New Jersey Litigation, Bernstein Liebhard LLP Reports

According to a Case List updated on July 8th, a total of 776 claims alleging complications associated with spontaneous migration of the device had been filed in New Jersey’s Bergen County Superior Court, where Bernstein Liebhard LLP is actively filing claims. All the cases in this state proceeding blame the IUD’s manufacturer, Bayer Healthcare Pharmaceuticals for injuries they claim to have been not properly warned about prior to insertion by a healthcare provider. In addition to nearly 780 Mirena lawsuits now filed in New Jersey’s Bergen County Superior Court, recent documents show a steady increase in the number of IUD claims pending in the Southern District of New York, where a multidistrict litigation is underway. A Case List updated July 15th by the U.S. Judicial Panel on Multidistrict Litigation (JPML) shows a total of 612 lawsuits now filed in the federal proceeding. Not unlike claims filed in New Jersey, court documents indicate that plaintiffs in the New York proceeding allege spontaneous IUD migration, uterine perforations and other side effects stemming from use of Mirena. They point out that the device warning label only alerts women of its potential to migrate if the uterus is perforated upon insertion.
According to claims, Bayer downplayed risks associated with the IUD and overstated its benefits, which they have a history of; based on a Warning Letter the company was sent by the U.S. Food and Drug Administration (FDA) in 2009. According to the letter, one of Bayer’s promotions of Mirena made misleading claims about the IUD’s safety and efficacy.
The Mirena IUD entered the U.S. market in 2000 as a contraceptive, and is now also approved as a treatment for heavy menstrual bleeding in women who use it as their preferred method of birth control.
