New Jersey Court Prepares to Discuss Mirena Lawsuits at IUD Status Conference in November
New York, NY (PRWEB) October 26, 2014 -- A New Jersey litigation involving Mirena lawsuits (http://www.mirenalawsuit2014.com/) is gearing up for a status conference next month in Bergen County Superior Court, where almost 1,100 cases have now been filed, Bernstein Liebhard LLP reports.
A Calendar posted on the Court’s website shows a Case Management Conference scheduled for November 18th, 2014 at 2:00 p.m. There, parties involved in the consolidated proceeding will discuss lawsuits over the Mirena IUD that allege spontaneous device migration, uterine perforations and other complications of the birth control implant. According to plaintiffs, Bayer Healthcare Pharmaceuticals failed to warn about these risks in its marketing of the device, which they accuse the company of designing defectively. Court records from September 17th show 1,093 Mirena lawsuits now filed in the consolidated litigation in New Jersey, where plaintiffs allege Bayer concealed information about Mirena's side effects and overstated its benefits. The company has been reprimanded for such behavior in the past, most notably in 2009, when the U.S. Food and Drug Administration (FDA) sent a Warning Letter to the company that took issue with a particular Mirena promotion that included misleading claims about the implant’s safety and effectiveness, according to claims.
Plaintiffs further allege that the uterine perforations, scarring, infection, adhesions, organ damage and other complications they experienced after receiving the IUD were a result of Bayer’s failure to adequately warn women about its potential to migrate away from the uterus.
Allegations included in Mirena lawsuits filed in New Jersey are shared by hundreds of others now pending in the U.S. District Court, Southern District of New York. There, a federal multidistrict litigation involving the IUD included 1,042 lawsuits as of October 15th.
