New Risperdal Lawsuits Added to Philadelphia Litigation, Bernstein Liebhard LLP Reports

Documents recently updated in the Philadelphia Court of Common Pleas show 1,079 records included in the state proceeding, all of which involve a drug approved to treat schizophrenia, bipolar disorder and other psychiatric conditions. Many of the cases in this proceeding allege symptoms of Risperdal gynecomastia, a painful and embarrassing condition categorized by male breast growth. Risperdal lawsuits filed in the Philadelphia Court of Common Pleas allege similar complications related to the use of the atypical antipsychotic medication, which is approved to treat irritability in children with autism, in addition to adults and adolescents ages 10-to-17 with schizophrenia and bipolar disorder. Claimants accuse Johnson & Johnson and Janssen of failing to properly inform men of the medication’s tendency to produce elevated levels of prolactin, a hormone associated with female breast development and lactation in new mothers.
According to lawsuits, Johnson & Johnson and Janssen have also engaged in off-label promotion of Risperdal, for uses not approved by the U.S. Food and Drug Administration (FDA). In November 2013, the companies agreed to settle charges from the U.S. Department of Justice that partially involved their alleged promotion of Risperdal to elderly patients with dementia and for pediatric uses not cleared by the agency until 2006. The federal government reported that the $2.2 billion settlementwas one of the largest federal case settlements involving healthcare fraud in history.
