New York, NY (PRWEB) July 23, 2013 -- An incident of Jaywalking proved fatal to an elderly resident of Bensonhurst, Brooklyn on July 13th. According to the New York Post (Elderly woman killed by car in Brooklyn, 7/14/2013), a 79-year old woman was talking on her cellphone and crossing the street against the light when she was struck by a vehicle just one block from her home.
According to the New York Post, the victim was crossing Bay Parkway near 72nd Street at around 9pm on Saturday, July 13 when she was struck by a four-door Dodge sedan.
The article goes on to say that despite attempts from onlookers to perform CPR, the victim was pronounced dead upon arrival at Lutheran Medical Center.
According to the article, no criminality is suspected in the death of the pedestrian.

1. When entering a roadway or crossing a street, pedestrians must always obey traffic signals, signs, and pavement markings.
2. Drivers generally must yield the right-of-way to a pedestrian.
3. Drivers entering or exiting from driveways, alleys, or building entries must yield the right-of-way to pedestrians on the sidewalk.
4. Drivers have to yield to pedestrians when there is no traffic light or signal, when pedestrian is in a crosswalk, and any time there is potential danger to the pedestrian.
5. However, pedestrians must yield the right-of-way to all vehicles on the roadway at mid-block locations when there is no crosswalk, sign, or signal. This is applicable for the middle of city blocks.
6. Pedestrians must stay on sidewalks where they are available and safe.
7. If pedestrians have to walk on the roadway because there are no sidewalks, pedestrians must walk toward traffic, on the left side of the roadway.
8. Pedestrians must stay off interstate highways, expressways, and some bridges.
9. At intersections or crosswalks, drivers must yield to pedestrians carrying canes or accompanied by seeing-eye dogs (or both).
10. Regardless of who has the right-of-way, drivers are required under New York state law to exercise as much care as possible pedestrians are present.
