New York City Workers’ Compensation Lawyer Edgar Romano Says New Survey Underscores Bias Against Injured Workers
New York, NY (PRWEB) December 17, 2014 -- A new poll indicating that more than one-third of Americans believe workers’ comp claimants are lazy reveals one of the many obstacles that legitimately injured workers face when seeking the benefits they need and deserve, New York workers’ compensation attorney Edgar Romano said today.
“It’s stressful enough to suffer an injury at work,” said Romano, a senior partner at New York City law firm Pasternack Tilker Ziegler Walsh Stanton & Romano L.L.P. “Injured workers typically are worried about their recovery and how it will affect their future. They shouldn’t have to worry about whether their bosses or the insurance companies think they are faking it. But we know these misconceptions and stereotypes exist, and that’s one of the reasons why injured workers often turn to experienced attorneys to help them.”
According to an article in Safety + Health, a new poll commissioned by workers’ comp pharmacy provider Summit Pharmacy found that 37 percent of Americans believe most workers’ compensation claims are made by employees who do not want to work (“37% of Americans believe workers’ comp claimants don’t want to work: poll,” Safety + Health, Dec. 3, 2014).
Summit Pharmacy and Harris Poll conducted a survey of more than 2,000 adults to obtain opinions of the workers’ comp process. According to Safety + Health, respondents between 18 and 34 years old were the most likely (42 percent) to think that people filing workers’ comp claims did not want to work.
Romano noted that the poll had other interesting findings suggesting that many people realize the workers’ comp claims process can be daunting. Thirty-four percent of workers believe it would be a “nightmare process” to get a prescription for pain medication if they were injured at work.
The poll also asked whether people agreed with the statement: “You need a Ph.D to compete all the necessary paperwork associated with a workers’ compensation claim.” Thirty-five percent of those polled agreed.
According to Safety + Health, Dr. Joel Morton, president of Summit Pharmacy, said in a press release: “Too often, injured workers face stigma and complications as they attempt to wade through complicated and frustrating bureaucracy. Work-related injuries often create a spiral of despair that affects entire families, sometimes permanently.”
As an attorney who has helped New Yorkers fight for their workers’ compensation benefits, Romano said he agrees with Morton’s assessment.
“These myths that people are faking their injuries just so they don’t have to go to work make a complex process even harder to get through,” Romano said. “One of our roles as advocates for the injured is to help people overcome these obstacles so they get the care they need. When we handle a workers’ comp case, we let our clients know that we will take on the burden for them. We want them to focus on their recovery. We work hard to uncover the facts and show the employer and its insurance company that the workplace injury is real and must be taken seriously.”
Romano said anyone injured on the job should promptly contact an experienced attorney for a free consultation.
