New York Personal Injury Lawyer Kenneth A. Wilhelm discusses Escalator Accident that Crushed Girl's Foot
New York, NY (PRWEB) November 25, 2013 -- A mall escalator in New Jersey that crushed an 11-year-old girl's foot causing her to lose two toes was not properly maintained, according to an Oct. 23 NBC news report. The girl was shopping with her mother and brother at Macy's in Garden State Plaza Mall Aug. 16 when they stepped onto the escalator, the report states. The girl's foot got entangled in the escalator, according to the article.
The girl had to undergo 15 surgeries on her foot and is still unable to take over 10 steps at a time, the report states. The escalator was found not to be running smoothly and in need of maintenance, for which reason, it was given a temporary certificate to operate. However, that certificate expired before the incident involving the young girl, the report states. Escalators in New Jersey are required to be inspected twice a year, but documents from Paramus show that the escalator in question was checked only once in 2012 and once in 2013 prior to the incident, according to the article.
Escalator accidents often result in serious injuries, says New York personal injury lawyer Kenneth A. Wilhelm. "As in this case, escalator accidents can lead to crushing and amputation injuries. Victims may also fall off the escalator steps suffering broken bones, head injuries, back and neck injuries."
In such cases, injured victims can file a premises liability claim against the property owner or manager seeking compensation for their losses, Wilhelm says. "Plaintiffs will be required to prove that the property owner and/or manager was negligent in failing to fix a danger on the property. All property owners have the responsibility to repair any hazard that is present on their property. If they do not fix it in a timely manner, the law requires them to post a sign alerting visitors and guests about the present danger." In one of our elevator accident cases (Index Number 13852/2006, Supreme Court, Bronx County), we recovered $3,000,000 for the injured person.
