New York Personal Injury Lawyer Kenneth A. Wilhelm Talks about Liability Issues in Slip and Fall Cases Involving Snow and Ice
New York, N.Y (PRWEB) February 17, 2014 -- With subzero conditions affecting much of the Northeast, New York City and the rest of the state have been pretty badly hit by snow and ice. Winter storms have been blasting the area causing power outages, traffic accidents and slip-and-fall accidents. According to a Feb. 8 report in The New York Times, emergency rooms in New York City have reported as much as a 300 percent increase in snow-related maladies including slip-and-fall accidents on ice.
New York Methodist Hospital in Brooklyn saw injuries including a dislocated shoulder, a dislocated elbow, a foot fracture and an ankle fracture on a Thursday between 8 a.m. and noon, when it is usually very quiet, the Times reports. Maimonides Medical Center in Brooklyn has treated 401 patients for falls and other injuries just in the past two weeks compared to 138 in a two-week period in November, the article states.
New York personal injury lawyer Kenneth A. Wilhelm states that injuries from slipping and falling on ice or snow can be quite severe. "People may suffer head injuries, dislocations, fractures, lacerations and even back and neck injuries. The recovery time for these injuries can be significant resulting in work days or school days lost."
The question then arises: Who is liable for a slip-and-fall incident on ice in New York City? Wilhelm says the law in this regard can be rather complicated. "It often depends on where the accident takes place," he says. "If the accident occurs outside a business, a place of worship or a multi-family dwelling such as an apartment complex, the property owner and/or manager can be held liable for the injuries and damages caused. However, if the incident occurs on a sidewalk outside a single-family residential dwelling, the city could be held liable."
Wilhelm says it would be in everyone's best interests to take necessary precautions when walking in wintery conditions.
• Wear supportive shoes with sufficient traction. Do not try walking in dress shoes or high heels.
• Try not to go out when conditions are extremely severe.
• If possible do not carry heavy bags. If possible keep your hands free so you can maintain your balance in slippery conditions.
• Walk slowly and carefully. Don't run.
• Do not be distracted by a cell phone or other electronic devices. Focus on walking and getting to your destination safely.
