Not Guilty: Neil Rockind Obtains Acquittal In Grosse Pointe Felony Drug, Weapon Possession And Unlawful Imprisonment Case

Following a two (2) day trial, the accused was only convicted of a misdemeanor, assault and battery. The trial lasted two (2) days. The case, State of Michigan v Didani, case number 14-001715-01-FH, was heard in the Wayne County Circuit Court in the Frank Murphy Hall of Justice. The Hon. Vonda Evans presided over the trial. The acquittal was greeted by the client and his family with tears.
During the trial, the complaining witness testified. According to her trial testimony, the accused went to a gentleman's club in Detroit, Michigan, and met up with the complainant, an exotic dancer. At the club, the complainant testified that she did lines of cocaine. The pair left the club together and, according to the complaint's trial testimony, went to an after hours club where the complainant admitted consuming more drugs. The complainant and the accused returned to the complaint's home in Grosse Pointe, Michigan and remained there until late the morning. According to trial testimony, the next morning, the complainant claimed that she wanted to leave but that the accused wouldn't let her leave. The complainant testified that the accused held her at gunpoint and then even forced her into her car while he drove. According to her trial testimony, the complainant claimed that he aimed a gun at her and threatened to kill her. While on the road, the complainant claimed that the accused would not let her out of the car and that she had to jump out of the car at a traffic light. Another driver testified that she observed the woman exit the car and run to her car asking for "help". The complainant's roommate testified as well in support of her story. According to police records, the police investigated and obtained a warrant for the accused's home. While executing the warrant, the police claim to have found a gun and that when examined for forensic evidence, fingerprints were located on the magazine. According to a state expert, the fingerprints matched the accused's.
The accused denied the allegations to the police, according to police records. At trial, the accused challenged the complainant's credibility, citing to inconsistencies in her account, portions of her claims that did not make sense or that were not reasonable and to her admitted drug and alcohol use. According to the trial testimony, the complainant admitted to using 10-15 lines of cocaine, drank tequila and used nitrous oxide in balloons throughout the night and morning. The complainant also had discontinued taking her anti-depressant mediation several days prior to the alleged incident, according to trial testimony. During the trial, it was also pointed out that another person was the actual named signor of the lease of the home.
According to court documents, the prosecution called (5) witnesses in the trial. The accused was ultimately acquitted of Unlawful Imprisonment, Felon in Possession of a Firearm, Felony Firearm, Domestic Violence and Assault with a Dangerous Weapon (Felonious Assault) and was only convicted of a misdemeanor, assault and battery.
