U.S. District Judge Joseph Goodwin will be appointing a settlement committee to aid in the process of settling about 30,000 of these cases.
These settlement talks could save manufacturers of trans vaginal mesh implants a lot of money, as past bellwether cases have resulted in plaintiffs being awarded millions of dollars for their pain and suffering. One of the first awards was granted to a New Jersey woman for $11.1 million dollars from her Ethicon vaginal mesh implant. The case is Gross v. Gynecare, Inc., Atl-L-6966-10, Superior Court of Atlantic City, New Jersey. In July of 2011, the FDA issued a warning to patients and surgeons about the potential risks involved with the implants. Recent studies have further shown that the use of the mesh implants did not increase the cure rates over traditional treatment for pelvic organ prolapse (POP) as reported by Obstetrics and Gynecology in the September 6th online edition. These findings should help guide surgeons and patients as they discuss if an implant is the best treatment for their medical condition.
