The motion was filed on December 2, 2013 and it describes a situation whereby allegedly no tangible steps were put in place by the defendant to place a litigation hold on documents that would have been relevant to the lawsuit. Employees allegedly decided on their own if particular documents should be preserved, and none were unless an employee took specific steps to do so.
The plaintiffs are requesting sanctions against the defendant because the alleged destruction of these documents is prejudicial to the plaintiffs who are seeking compensation for injuries allegedly suffered as a result of using these products.
