Porsche Owners and Lessees Have Until October 15th, 2013 to File a Claim Pursuant to a Class Action Settlement Regarding IMS Engine Damage

Harris, announces that the deadline is rapidly approaching for individuals to make claims for reimbursement for repairs made on their Porsches under the terms of the settlement reached in Eisen v. Porsche Cars North America, Inc., United States District Court for the Central District of California, Case No. CV11-09405 CAS (FFMx). This class action lawsuit addresses the problem of engine damage and catastrophic engine failure caused by a defective component part, the Intermediate Shaft, or “IMS.” Individuals who experienced IMS-related engine damage or loss on or before July 17, 2013 have until October 15, 2013 to submit their claim for reimbursement.
Under the terms of the settlement, present and former owners and lessees of certain Porsche 911 or Boxster vehicles in model years 2001-2005 who experienced a failure of the IMS may be reimbursed for up to 100% of their out-of-pocket costs for engine repair or replacement, in addition to towing and vehicle rental fees incurred during the repair period up to a combined total of $200. The precise percentage of reimbursement available depends upon the mileage on the vehicle at the time of the repair and whether the vehicle was purchased new or used either within or without the Porsche Approved Certified Pre-Owned Program. Eligible vehicles are covered for up to ten years after the vehicle was placed in service or for up to 130,000 miles. “Notwithstanding what Porsche employees may be representing to class members regarding the Eisen v. Porsche Cars North America, Inc. case settlement, it is important to correctly understand the terms of the settlement,” class counsel, Stephen Harris said. “We have been receiving reports from class members that Porsche employees staffing the Porsche 1-800-486-9809 number established to screen class member inquiries about post-July 17, 2013 IMS related engine damage or failures are erroneously refusing to handle claims of class members who are entitled to benefits under the settlement.”
The Eisen v. Porsche Cars North America, Inc., class action settlement terms include the following:
1. Reimbursements under the settlement for repairs are available to all qualified class members whose vehicles had IMS-related engine damage, not only those whose class vehicles had total and complete IMS-related engine failure.
2. A class member is eligible for reimbursement so long as the IMS-related engine damage occurred within the ten year window period or up to 130,000 miles, whichever comes first. It is irrelevant if the repairs occurred after the ten year window or after the class vehicle exceeded 130,000 miles, so long as the claim for benefits is timely submitted.
3. The “in-service” date is normally when the vehicle is first sold and the warranty commences, not the date the vehicle was manufactured.
4. Class members who suffered pre-July 17, 2013 IMS-related engine damage and had or are having their class vehicles repaired after July 17, 2013 are eligible for settlement benefits, no matter where they had their vehicle repaired. The repairs do not have to be performed by Porsche. Class members in this circumstance should contact Class Counsel immediately.

The October 15, 2013 claims deadline applies to covered owners or lessees who experienced IMS –related engine damage or failure on or before July 17, 2013.
Those class members who have a 2003, 2004 or 2005 Class Vehicle and who have not yet experienced the IMS failure or had related damage do not need to fill out the claim form and submit it to the Settlement Administrator at this time. However, covered owners who experience IMS failure after July 17, 2013 must contact Porsche directly at 1-800-486-9809 to initiate the claims process.
