Prostate Cancer Added to List of Diseases Eligible for Zadroga Act Coverage; Parker Waichman LLP Applauds Decision

This decision comes about three weeks before the registration deadline for the September 11th Victim Compensation Fund, as reported by the U.S. Department of Health and Human Services on Sept. 19. It noted that, back in September 2012, the National Institute for Occupational Safety and Health (NIOS) had added about 50 cancers to the list of diseases covered under the James Zadroga 9/11 Health and Compensation Act of 2010. Prostate cancer was noticeably missing from the list. Then in May 2013, the New York City Patrolmen's Benevolent Association filed a petition to add the cancer. NIOSH published a proposed rule to add the cancer in July; the final rule, which added prostate cancer, was posted on the Federal Register on Sept. 19.
The Zadroga Act, which became law in December 2010, was named for deceased New York Police Department detective James Zadroga, who had worked at Ground Zero, as noted in Public Law 111, issued on Jan. 2, 2011. Many of the individuals who participated in the rescue and recovery efforts following the 9/11 terrorist attacks have since been diagnosed with various illnesses because of their exposure to toxic dust, as reported by The Lancet on Sept. 3, 2011. The Zadroga Act reopened the 9/11 Victims Compensation Fund for five years to provide payment for job and economic losses for first responders, those trapped in the buildings, and local residents, who suffered illnesses or injuries related to the toxic dust, the U.S. Department of Justice noted in a press release at the time.
