The Complaint alleges that the Associate Chemists employed by Ampac in California were improperly classified as exempt from receiving overtime pay and related benefits, such as meal and rest breaks.
The class action lawsuit claims that the Associate Chemists engaged in a finite set of non-exempt tasks throughout their shift, including maintaining instruments through basic cleaning and upkeep, conducting inventory of assigned chemicals, ordering chemicals, following good manufacturing practice guidelines while performing work for Ampac, and performing analytical testing through various tests and techniques all in accordance with Ampac's company policies. The Complaint also alleges that the Associate Chemists spent no time supervising other employees working for Ampac. As a result, the lawsuit alleges that the Associate Chemists were misclassified and therefore should have been provided with overtime pay and the legally required thirty minute uninterrupted meal periods.
