Saia & Piatt Helps Client Obtain Less Serious Conviction in OVI Case
Columbus, OH (PRWEB) April 01, 2014 -- With the assistance of Attorney Jon Saia, a New Lexington man who faced OVI and traffic charges was able to secure a much less severe conviction and sentence through a plea deal. In Perry County Court Criminal Case Number CRB 1300271 and Perry County Court Traffic Case Number TRC 1300618 (Perry County Municipal Court in Perry County, Ohio), the defendant was charged with operating a vehicle while under the influence of alcohol (OVI), reckless operation of a motor vehicle, failure to control, and child endangering for failing to properly restrain a 7-year-old child who was in the vehicle.
According to court documents, the charges were filed after the defendant drove while intoxicated and struck parked cars. A young child was unrestrained in the vehicle at the time of the accident and the child’s head hit the windshield, causing minor injuries.
Court records state that the defendant’s urine test results showed a .147% alcohol content. Attorney Saia filed a Motion to Suppress Evidence, and after the hearing the urine alcohol test and all Standardized Field Sobriety Tests were suppressed, court documents show. A Motion in Limine was also granted, court records show, and so evidence of the defendant failing to use the proper child restraint could not be used for any purpose other than a violation of that particular statute.
According to court records the defendant plead Guilty to the seat belt violation charge and No Contest to the remaining facts. The defendant was found Guilty of Failure to Control. The resulting sentence—an order to pay a $225 fine and court costs—was much less severe than what the client would have suffered had the case resulted in a conviction for all of the initial charges.
