San Francisco Labor Law Attorneys Blumenthal Nordrehaug & Bhowmik File A Class Action Lawsuit Against Comcast for Alleged Unpaid Commission Wages
San Francisco, California (PRWEB) July 29, 2013 -- On June 10, 2013 the San Francisco labor lawyers at Blumenthal, Nordrehaug & Bhowmik filed a class action lawsuit against Comcast for allegedly denying their Account Executive employees commission wages that were owed to them. Hurley, et al. vs. Comcast of California/Colorado/Texas/Washington, Inc. ("Comcast"), Case No. 253801 is currently pending in the Sonoma County Superior Court for the State of California.
According to the class action complaint filed against Comcast, the Account Executives are responsible for producing revenue for Comcast and receive commission wages for the products and services sold for Comcast. The Complaint claims that Comcast's compensation plan fails to pay the Account Executives commission wages for earned commission on a completed sale if customer payment is not received within ninety days for direct purchasers or one-hundred and twenty days for agency purchasers.
The Complaint alleges that "[t]he forfeiture of earned commissions is unlawful because these employees performed all the acts required of them to be performed to earn the commission and Comcast received payment from the customers as a result of the worked performed by the Plaintiff."
The case is in the infant stages of litigation and no decision has been made by the Court as to the alleged claims.
