Sandra Birdwell Alleged Negligence Suit Moves Forward as Case Proceeds to Trial
(PRWEB) May 10, 2016 -- Zagoria Law, an Atlanta-based law firm specializing in personal injury cases, has delivered discovery responses in the alleged negligence suit of Sandra Birdwell vs. Charles Hetzer and Elizabeth Hetzer (Defendants). The original complaint for damages was filed in the Superior Court of Greene County, Georgia on March 9, 2015, civil action file number 15-CV-079.
The suit alleges that the Defendants were negligent in and responsible for a fall sustained by Birdwell on July 25, 2013 at 1090 Penfield Way, Greensboro, Georgia 30642 located in the Reynolds Plantation community. Birdwell suffered a fractured tibia and a torn Achilles tendon. Zagoria is seeking an unspecified amount of pain and suffering damages for Birdwell and is asking for special damages in an amount not less than $46,713.63.
According to suit documents, Birdwell was an invited guest at the lake home, which the Defendants allegedly owned at the time. As Birdwell crossed the porch and moved away from the front door, the suit alleges, she violently fell from a drop off on the porch, known as a “one-step” riser.
The suit further alleges, among other points:
- The drop off was a hazardous condition on the premises.
- The Defendants had actual and/or constructive knowledge of the dangerous conditions but failed to take any action—or failed to take adequate action to remedy the dangerous condition.
- The failure of the Defendants to remedy the dangerous condition created by the aforementioned drop off amounts to alleged negligence.
- Defendants were further allegedly negligent in failing to warn Birdwell of the dangerous conditions created by the drop off.
