San Francisco, California (PRWEB) November 11, 2014 -- The San Francisco labor law attorneys at the law firm of Blumenthal, Nordrehaug & Bhowmik announce an opportunity for current and former security guards of Silicon Valley Security & Patrol, Inc. to join a class action lawsuit against the security service provider for allegedly implementing an unlawful, unfair and deceptive meal and rest break policy. The complaint against Silicon Valley Security & Services, Inc. was filed on August 26, 2014 alleging meal and rest break violations on behalf of the company's non-exempt, hourly employees working in California. The case is currently pending in the Santa Clara County Superior Court for the State of California, Case No. 114CV269937. The Complaint can be read here.
The complaint alleges that Silicon Valley does not have a policy or practice which provides meal and rest breaks to their employees thereby resulting in a failure to provide all legally required off-duty meal and rest breaks to their security guard employees who were paid on an hourly basis in California. The complaint further alleges that Silicon Valley failed to compensate the Plaintiff and other security guards for missed meal and rest breaks. The California Labor Code, and specifically California Labor Code Sections 226.7 and 512, state that employees who are classified as non-exempt and paid on an hourly basis are legally entitled to take 30 minute uninterrupted meal breaks, meaning no work is required to be performed during the required off-duty meal period.
The California labor law attorneys at Blumenthal Nordrehaug & Bhowmik are now ready to represent other Silicon Valley security guards working in California.
