Highlights of selected legislation covered in the newly updated protocol include:

  • Under Environment Canada’s Greenhouse Gas (GHG) Emissions Reporting Program, a notice is published every year in Part I of the Canada Gazette outlining the GHG reporting requirements for the corresponding calendar year. There were no changes to the reporting requirements from those provided in the notice for 2013. The “Notice with Respect to Reporting of Greenhouse Gases for 2014,” published on October 11, 2014, applies to the 2014 calendar year.
  • Under the “Canadian Environmental Protection Act, 1999,” owners or operators of facilities that meet published reporting requirements are required to report to the National Pollutant Release Inventory (NPRI). NPRI Notices are published for designated reporting years in Part I of the Canada Gazette. The most recent notice was published on July 12, 2014 for the 2014 and 2015 reporting years.
  • The “Canadian Prohibition of Certain Toxic Substances Regulations, 2012” repeal and replace the “Prohibition of Certain Toxic Substances Regulations, 2005.” The new Regulations apply to any person who manufactures, uses, sells, offers for sale or imports any of the 22 toxic substances listed in the Regulations, or a product containing any of these substances. There are exemptions provided in the Regulations for the manufacture, use, sale, offer for sale or import of products where the substances are incidentally present and/or for the use of substances or products containing them in a laboratory for analysis, scientific research or as an analytical standard.
  • Quebec’s “Regulation RCG 08-041, Rules Related to Release into the Works of Sanitation in the Territory of the City of Montreal” requires a facility to have a discharge permit if wastewater discharges exceed 10,000 m3/year, or if they contain certain pollutants. While the previous regulation (“Regulation 87” (“Regulation 2001-9 CMM”)) was repealed on January 1, 2012, a discharge permit already issued under the previous regulation remains in effect under “Regulation RCG 08-041.”
  • Quebec’s new “Water Withdrawal and Protection Regulation” provides terms and conditions for authorizations for the withdrawal of water and prescribes certain standards for water withdrawals, water withdrawal facilities and facilities or activities that may affect the quality of water withdrawn in the vicinity. It ensures, in particular, the protection of water withdrawn for human consumption or food processing purposes.
