Highlights of selected legislation covered in the newly updated protocol include:
• The “Notification of the Department of Industrial Works Re: Notification and Acknowledgement/or Environmental Personnel in the Factory B.E. 2556 (2013)” requires facilities to employ and notify the appointment of registered environmental personnel to the Department of Industrial Works.
• The “Notification of the Ministry of Natural Resources and Environment Re: Types and Sizes of Projects or Businesses that must prepare an Environmental Impact Assessment Report, and the Criteria, Methods, Procedures and Practices in Preparing an Environmental Impact Assessment Report No. 3 (2013)” revises the sizes and types of projects required to prepare Environmental Impact Assessments.
• “Ministerial Regulation No. 22 (B.E. 2556) under the Factory Act B.E. 2535 (2013)” requires a facility generating industrial waste to obtain approval from the Ministry of Industry prior to transferring the waste off site. This Regulation also specifies non-hazardous wastes designated by the Minister that are exempt from these requirements.
• “Ministerial Regulation Re: Prescribing the Standard in Management of Safety and Occupational Health and the Working Environment Relating to Protection and to the Prevention of Fire B.E. 2555” requires the facility to develop a fire protection and prevention plan and to provide and maintain fire suppression and fire-fighting equipment. The Regulation also includes requirements for the storage of combustible and flammable or explosive materials, as well as gas cylinders.
• The “Notification of the Department of Land Transport Re: the Placards, Pictograms and Signs on Vehicles for Transportation of Dangerous Goods B.E. 2555 (2012)” requires the placarding of vehicles used for the transportation of dangerous goods with information on the primary and subsidiary risks according to the class and division of dangerous goods. Such placards must comply with the requirements established within the “European Agreement Concerning the International Carriage of Dangerous Goods by Road (ADR).”
• The “Notification of the Industrial Estate Authority of Thailand No. 62/2555 (2012) Re: the Reporting of Performance according to the Risk Management Plan as specified in the Risk Assessment Report from Hazards that may Arise from a Factory’s Operations” requires specified facilities to conduct an annual risk assessment and submit an annual risk assessment report to the Industrial Estate Authority.
• “Ministerial Regulation Re: Prescribing Experts to Perform the Work Related to the Use, Storage and Filling of Gas at the Factory (No. 2) B.E. 2555 (2012)” requires any facility using 20 or more cylinders of the gases specified by the Minister (such as, but not limited to, carbon dioxide, oxygen, and nitrogen) to use registered (trained) workers.
• “The Notification of the Ministry of Industry on the List of Hazardous Substances B.E. 2556 (2013)” repeals and replaces numerous Ministry of Industry notifications regarding hazardous substances and updates the list of hazardous substances prescribed under the “Hazardous Substance Act.”
• “Ministerial Regulation Re: Prescribing Administration, Management and Implementation Standards for Occupational Safety, Health and Environment Related to Hazardous Chemicals B.E. 2556 (2013)” specifies the safety requirements related to working with hazardous chemicals, including labelling, packaging, first aid, emergency response, training and placarding.
• The “Notification of the Department of Labor Protection and Welfare Re: List of Hazardous Chemicals (2013)” prescribes the list of hazardous chemicals for which the facility must prepare a report to submit to the agency.
• The “Notification of the Department of Labor Protection and Welfare Re: Test and Issue of Certificate of Occupational Safety Promotion Personnel in the Construction Business (2014)” prescribes the mandatory qualifications for construction work safety officers.
