Highlights of selected legislation covered in the newly updated protocol include:
• Changes to requirements for ozone depleting substances were issued in the form of amendments to the national "Ozone Protection and Synthetic Greenhouse Gas Management Act 1989" and the "Ozone Protection and Synthetic Greenhouse Gas Management Regulations 1995." These changes impact requirements for the manufacture and import of ozone depleting substances and requirements relating to refrigerants, extinguishing agents, and discharge of scheduled substances. Exemptions for certain types of equipment have been expanded and requirements of license holders and for recordkeeping have been revised.
• Changes to the "National Greenhouse and Energy Reporting Act 2007" and the "National Greenhouse and Energy Reporting Regulations 2008" have resulted in changes to the greenhouse gas registration and reporting requirements. In addition, the "Clean Energy Act 2011," which established a carbon pricing mechanism and trading scheme, was repealed effective 1 July 2014. The "Clean Energy Act 2011" had required liable entities to register and report annually on their emissions or potential emissions in relation to the 2012-13 and 2013-14 financial years under the "National Greenhouse and Energy Reporting Act 2007."
• Amendments to the "Protection of the Environment Operations (General) Regulation 2009" revised the definition of “native forest bio-material” as applicable to the regulations that restrict burning of native forest bio-material.
• Changes to the solid and hazardous waste requirements were issued under the Protection of the "Environment Operations (Waste) Regulation 2014," which replaced the 2005 regulation. Key changes include new thresholds for environment protection licenses, a new proximity principle for waste transport, and reforms to the waste levy system.
• Changes to water resource management requirements were issued under the "Water NSW Regulation 2013," which replaced the "Sydney Water Catchment Management Regulation 2008." Declared catchment areas and controlled areas in the greater Sydney area are covered by this regulation.
• Changes to the requirements for above and below ground tank management were issued under the "Protection of the Environment Operations (Underground Petroleum Storage Systems) Regulation 2014." This "Regulation" took effect 1 September 2014 and replaced, with some amendments, the "Protection of the Environment Operations (Underground Petroleum Storage Systems) Regulation 2008." The amendments include clarification of the statutory requirements for the management and operation of underground petroleum storage system (UPSS) infrastructure in NSW.
• Amendments were issued to the "Work Health and Safety Regulation 2011." These changes affect requirements for high risk work, diving work, plant and major hazard facilities, and the safety requirements for tractors and earthmoving machinery in construction work.
• The "Dangerous Goods (Road and Rail Transport) Regulation 2009" was repealed and replaced by the "Dangerous Goods (Road and Rail Transport) Regulation 2014." From 1 July 2014 in NSW, all newly manufactured dangerous goods vehicles must have electronic stability control (ESC) installed, or they will be banned from its roads.
• New radiation safety requirements under the "Radiation Control Regulation 2013" went into effect on July 1, 2013, replacing the "2003" regulation. These changes affect the licensing and registration requirements and security of radioactive sources. Requirements relating to the 2003 regulation have been removed from the protocol.
