Highlights of selected legislation covered in the newly updated protocol include:
• “Act on the Improvement of Energy Consumption Performance of Buildings [Law No. 53 of July 8, 2015],” as well as the supporting “Enforcement Regulation, Ministerial Order,” and “Cabinet Order” providing additional specifications regarding the requirements in the Act, were added to this Protocol. This legislation incorporates new requirements regarding building energy consumption performance.
• Several significant updates were made to the PCBs section of this protocol due to amendments to the legislation regarding PCB waste requirements for “storing business entities” and “owning business entities.”
• Amendments to the “Ordinance on Industrial Safety and Health [Ministry of Labor Ordinance No. 32 of September 30, 1972; last amended by Ministry of Health, Labour and Welfare Ordinance No. 29 of March 29, 2017]” resulted in new and updated requirements regarding preventing psychological stress and working at heights with rope.
• Amendments to the “Industrial Safety and Health Law [Law No. 57 of July 8, 1972; last amended by Law No. 17 of May 7, 2015]” resulted in new and updated requirements regarding second-hand smoking at workplaces and risk assessment for chemicals at the workplace.
• Amendments were made to the lists of “Specified Chemical Substances, Concentrations of Substances Required to Have Local Exhaust Ventilation, and Harmful Work Substances.” The new substances include ortho-toluidine, naphthalene, refractory ceramic fibers, and sulfuric acid, and in some instances include preparations containing 1 percent or more by weight of the substance. These amendments were made to the “Cabinet Order for Industrial Safety and Health Law [Cabinet Order No. 318 of August 19, 1972; last amended by Cabinet Order No. 60 of March 29, 2017]” and the “Ordinance on Prevention of Hazards Due to Specified Chemical Substances [Ministry of Labor Ordinance No. 39 of September 30, 1972; last amended by Ministry of Health, Labour and Welfare Ordinance No. 29 of March 29, 2017].”
• Amendments were made to the Class I and Class II Designated Substances list, which are now available online in English. The weblink has been provided throughout the protocol, as necessary. Amendments were also made to the Class I Specified Chemical Substances list. These amendments were made to the “Cabinet Order for Law Concerning Examination and Regulation of Manufacture, etc. of Chemical Substances [Cabinet Order No. 202 of June 7, 1974; last amended by Cabinet Order No. 52 of March 2, 2016].”
