(PRWEB) February 10, 2015 -- Tom Moses, president of Spill Center, a North American leader in spill support and environmental claims management, discusses strict liability as it relates to environmental releases, focusing on the legal responsibilities of the spill generator in a new educational podcast.

Mr. Moses, who holds a law degree and a Certificate in Hazardous Materials Control and Emergency Response, explains that all environmental liability is considered “strict liability,” meaning without regard to fault.

“It doesn’t matter that the spill wasn’t your fault, you are still responsible or legally liable because of who you are: the party with care, custody and control of the spilled material,” he relates. By law, you are responsible for the following:

  • Report
  • Respond
  • Remediate
  • Dispose of spilled materials safely and legally
  • Cover damages associated with liability

He observes that spills of hazardous materials, diesel fuel and other regulated substances are subject to a maze of environmental regulations. Nearly 30,000 federal, state, provincial and local jurisdictions across North America require incident reports from spill generators. Fines and penalties for failure to comply with reporting regulations can be stiff, he notes.

In the podcast, Mr. Moses discusses costs associated with spills and ways to control them, while limiting the spill generator’s potential liability in the event of third-party legal action. He also talks about the best way to handle demands for reimbursement from fire departments and other emergency responders. In addition, he addresses spill preparedness and how companies can improve their readiness to handle spills.
