Stryker Hip Lawsuit News: Key Milestone Achieved in Federal Court Cases, Rottenstein Law Group LLP Reports

A leadership structure for plaintiffs’ counsel was ordered, according to court documents. “In this instance, Judge Donovan W. Frank is ordering the selection of a single lead counsel,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “The court looks at certain criteria in making its decision for a single plaintiffs’ attorney to head up the plaintiffs’ side of the lawsuit consolidation, also called a ‘multidistrict litigation.’ These include experience with other MDLs, especially hip implant litigation. It helps to have experience working with other lawyers in these types of consolidations as well.”
Rottenstein said that what it means for Stryker plaintiffs in the MDL is that “coordination provides for an efficiency that would allow for lawsuits to get a chance at a trial and damages award more quickly than if a large number of lawyers were functioning on their own.”
Metal poisoning, AKA “metallosis,” is among the most frequently alleged side effects of metal-on-metal hip implants such as the Stryker ABG II and Rejuvenate, according to the U.S. Food and Drug Administration.** The ailment occurs when metal debris from the friction among the implant’s metal components sheds into and accumulates in a patient’s bloodstream.
