Stryker Hip Lawsuit News: New Case Management Order Issued in New Jersey Stryker Hip Recall Litigation, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) January 30, 2014 -- Early mediation efforts continue in the multi-county litigation established in New Jersey’s Bergen County Superior Court for Stryker hip lawsuits (http://www.strykerhiprecallclaims.com/) filed in the wake of the 2012 recall of Rejuvenate and ABG II Modular-Neck Hip Stems, Bernstein Liebhard LLP reports. According to a Case Management Order dated January 28th, eight of ten cases selected for Phase I of early mediation have completed the process, and five of those lawsuits have been resolved. Discussions continue in a sixth case, while a seventh has been deferred due to the plaintiff’s ongoing medical treatment. An eighth Phase I case that was withdrawn from mediation due to medical issues is in the process of being rescheduled. According to the Order, the parties are also in the process of selecting Stryker hip recall claims for Phase II of early mediation.

Court documents indicate that 664 Stryker hip lawsuits are currently pending in the multicounty litigation underway in New Jersey. Plaintiffs in these lawsuits are alleged to have suffered a number of serious complications due to Rejuvenate and ABG II hip stems, including metallosis, adverse local tissue reactions, necrosis, osteolysis, and failure of the hip. The lawsuits further allege that these injuries are the result of toxic metal ions shed by the devices due to their propensity to fret and corrode.
According to court records, more than 500 Stryker hip lawsuits that involve similar allegations have also been filed in a multidistrict litigation underway in U.S. District Court, District of Minnesota. (In re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, MDL No. 2441)
The Stryker hip recall was announced in July 2012, after it was determined that Rejuvenate and ABG II hip stems were subject to a high rate of corrosion at the modular-neck junction. According to Stryker’s recall notice, this occurrence could cause recipients to suffer pain, swelling and adverse local tissue reactions, which in some cases may warrant removal of the implant. However, not all patients with a defective component will experience symptoms, prompting Stryker to recommend that all Rejuvenate and ABG II recipients undergo blood and imaging tests to ensure their device is functioning properly.*
