Court documents indicate that an Alabama man has filed what might be the first testosterone lawsuit in the state of Pennsylvania against the manufacturer of Testim. According to the complaint, which is pending in the Philadelphia Court of Common Pleas on March 17, 2014, the 64-year-old Plaintiff began using Testim in 2011, and at the time had no prior history of cerebrovascular disease or neurological impairments. Among other things, the lawsuit alleges that the Plaintiff’s use of Testim resulted in a “cardiovascular accident,” and an eventual diagnosis of concomitant erythrocytosis and clinical hyperviscosity syndrome. Three to four months after he discontinued treatment with Testim, the Plaintiff’s hematocrit levels returned to normal, according to the complaint.
“This complaint joins several other testosterone treatment lawsuits that have been filed in courts around the country since federal health regulators raised concerns about the heart risks associated with AndroGel, Testim, and similar medications earlier this year,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. Testosterone Treatment Lawsuits
According to court documents, testosterone therapies like AndroGel and Testim are approved to treat hypogonadism (low or no testosterone) in men who suffer from the condition due to an underlying illness or injury. In January 2014, the U.S. Food & Drug Administration (FDA) revealed that it had launched a safety review of prescription testosterone therapies after two studies found a high rate of serious cardiovascular events in men with preexisting heart problems who used the medications. The FDA has not yet concluded that these drugs will raise the risk of such heart events, but has advised doctors to weigh their risk and benefits when they are prescribed.
Since then, court records indicate that a number of testosterone treatment lawsuits have been filed in courts around the country on behalf of men who suffered serious heart injuries, allegedly due to their use of these medications. In addition to the case pending in Pennsylvania, a Testim lawsuit was filed on February 26, 2014, in the U.S. District Court, Northern District of California by a man who claims his use of the testosterone therapy resulted in a stroke. Court documents filed in the U.S. District Court, Northern District of Indiana indicate that five AndroGel lawsuits are currently pending in that jurisdiction. These include four cases filed on February 4th on behalf of men who allegedly suffer heart attacks, strokes and heart failure due to their use of the medication. (Case Nos: 1:14-cv-00776, 1:14-cv-00780, 1:14-cv-00777, and 1:14-cv-00772) The Fifth AndroGel lawsuit was filed on February 10th and claimed that the Plaintiff suffered pulmonary embolism, deep vein thrombosis, and other serious cardiovascular injuries after using multiple doses of the drug.
