The Los Angeles Labor Law Lawyers at Blumenthal, Nordrehaug & Bhowmik File First Amended Complaint Against The Industrial Company For Alleged Unpaid Wages
Orange County, California (PRWEB) February 08, 2016 -- On February 8, 2016 the Los Angeles labor lawyers at Blumenthal, Nordrehaug & Bhowmik filed a First Amended class action Complaint alleging that The Industrial Company failed to pay their hourly employees the correct amount of overtime wages and allegedly failed to provide their California employees with meal and rest periods in accordance with the California Labor Code.
The Industrial Company class action lawsuit, Case No. 5:16-cv-00186-VAP-SP is currently pending in the United States District Court for the Central District of California. A copy of the class action Complaint can be read by clicking here.
According to the class action complaint the company allegedly paid their non-exempt employees non-discretionary bonus wages based on their performance for the company. The Complaint further alleges the various bonus wages received by TIC's employees should have been included in the employees' hourly rates for the purposes of paying their employees the correct overtime wages. As a result of the alleged illegal overtime calculations conducted by TIC, the class action lawsuit claims other non-exempt employees working for TIC were also not correctly paid all their overtime wages.
In addition to the overtime claim, the lawsuit also seeks penalties relating to alleged missed meal breaks because allegedly The Industrial Company did not have a policy to provide their California employees thirty (30) minute uninterrupted meal breaks prior to their fifth (5th) hour of work.
