According to the class action lawsuit filed against SMX, LLC, the company allegedly required their drivers to show up to work but did not furnish their workers with at least half of their normal work schedule. The lawsuit claims that SMX failed to pay their drivers the reporting wages owed under California law.
The Complaint also alleges that the employees working for the company in California were not always able to take their thirty minute uninterrupted meal breaks before their fifth hour of work. California law requires employers to provide their non-exempt employees paid on an hourly basis with thirty minute meal periods before the employee works five hours.
