The San Francisco Employment Attorneys at Blumenthal, Nordrehaug & Bhowmik Sue Robert Half For Allegedly Denying Their Recruiting Managers Overtime Pay
San Mateo, California (PRWEB) September 17, 2014 -- On September 5, 2014, the San Francisco labor lawyers at Blumenthal, Nordrehaug & Bhowmik filed a proposed class action lawsuit against Robert Half International, Inc. for allegedly denying their employees employed in the position of a Recruiting Manager overtime wages and proper meal and rest periods. The class action complaint alleges that California law requires Robert Half International to pay all Recruiting Manager employees overtime wages for their time worked in excess of eight (8) hours in a workday and/or time worked in excess of forty (40) hours in any workweek. The proposed class action Complaint also claims that the Recruiting Managers employed by Robert Half International are "managers in name only" and that Robert Half International allegedly misclassified the Recruiting Managers because these employees fail to meet all the criteria under any of the exemptions to overtime pay in California. As a result, the lawsuit seeks an unspecified amount of back overtime wages on behalf of the proposed class of Recruiting Managers.
Specifically, the Complaint alleges "[t]he Recruiting Managers engaged in the finite set of tasks of relaying candidate information back and forth between Robert Half's clients and recruiters. In addition, these employees also spent the vast majority of their workday performing related clerical tasks, paperwork, client information updates, searching for and calling clients located in Robert Half’s database, selecting and placing candidates on job orders and securing client offers in accordance with Robert Half’s sales cycle and policies." The Complaint asserts that based upon the job tasks listed above, Robert Half International's Recruiting Mangers should have been paid overtime wages.
