Tip Sheet on How to Transfer Florida Timeshares Due to Divorce and Marriage by Deed and Record

Until the former spouse is removed from title as the owner of a Florida timeshare he or she is still responsible for the maintenance fees and property taxes. Until the former spouse is removed as owner he or she continues to have access and use of the timeshare.
In a new marriage the new spouse does not have access to use timeshare or to communicate with the resort company. On the death of the owner spouse the timeshare can only be transferred to the surviving spouse through the probate court. To allow access and avoid probate the new spouse must be added as co-owner of the Florida timeshare.
Removal of a spouse due to divorce as owner is by deed. Addition of a spouse due to marriage as owner is also by deed. A deed is a letter size paper formatted to meet the requirements of Florida Statute.
Florida Statue requires the owning spouse to sign the deed conveying one-half ownership to the other spouse. The signature must be both witnessed and notarized. Florida requires two witnesses and the notary may be one of the witnesses.
The signed deed is provided to the Court Clerk in the County where the timeshare resort is physically located. The Clerk records the deed to make the deed part of the public record of real property in that county.
A copy of the recorded deed must be provided to the vacation resort company to update their records. Until the resort company receives a copy access and use of the timeshare will not change. Each resort company charges a fee for the service to update their records and the charge varies from resort to resort.
