Transvaginal Mesh Injury Lawsuits: Parties Consider Federal Case Consolidation Milestones, Rottenstein Law Group LLP Reports
(PRWEB) November 19, 2013 -- There are several important vaginal mesh lawsuit dates scheduled in the American Medical Systems case consolidation in federal court, according to court documents. Throughout the spring of 2014, parties involved in the AMS vaginal mesh multidistrict litigation are required to complete pretrial tasks such as discovery (the reporting of information between those parties) and identify expert witnesses and schedule their depositions as part of the preparation for the potential trials for individual lawsuits, according to court documents (In re: American Medical Systems, Inc., Pelvic Repair System Products Liability Litigation; MDL-2325, U.S. District Court for the Southern District of West Virginia).
The third round of bellwether trials in the AMS MDL is scheduled to begin in August 2014, according to court documents. In the meantime, attorneys for the plaintiffs and defense are required to submit rankings for vaginal mesh lawsuits that would serve as the best bellwether trials.
“Bellwether cases are those that are chosen because they are thought to best represent the remainder of the cases pending,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP, “and trials of bellwether cases should help predict how trials of the rest will turn out.”
C.R. Bard, AMS, Coloplast, Cook Medical and Boston Scientific are major mesh manufacturers in the vaginal mesh MDL who are considering settling tens of thousands of transvaginal mesh lawsuits, according to a Sept. 30 Bloomberg article.* Johnson & Johnson’s Ethicon subsidiary is reportedly not a participant in the talks, the article said. In 2013 AMS parent company Endo has already paid out more than $50 million in vaginal mesh settlements.
