Transvaginal Mesh Lawsuit Defendant Seeks Removal of Pennsylvania Cases to Federal Litigation, Bernstein Liebhard LLP Reports

According to a Notice filed on February 11th by Boston Scientific Corp., the company is seeking the removal of dozens of cases involving its pelvic mesh products from a mass tort proceeding currently underway in the Pennsylvania Court of Common Pleas in Philadelphia. The Notice, which is now pending before the U.S. District Court, Eastern District of Pennsylvania, requests that the docket be transferred to the multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, where Boston Scientific is named a defendant in more than 15,000 vaginal mesh claims. According to court documents, all of the transvaginal mesh lawsuits pending against Boston Scientific were filed on behalf of women who allegedly suffered mesh erosion, chronic pain, organ damage and other serious vaginal mesh complications as a result of the company’s surgical mesh devices used to treat pelvic organ prolapse and stress urinary incontinence.
