Transvaginal Mesh Lawsuit Filings Exceed 10,000 in Federal Ethicon Gynecare Litigation, Bernstein Liebhard LLP Reports
New York, NY (PRWEB) September 29, 2013 -- More than 10,000 cases have now been filed in a federal litigation of Ethicon transvaginal mesh lawsuit claims (http://www.vaginalmeshlawsuit2015.com/) currently pending in the U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports.
According to a Case List update from September 24th, 2013, a total of 10,108 lawsuits alleging injuries from the company’s line of Gynecare mesh products have been filed in the federal proceeding. These claims were brought on behalf of women who may have sustained mesh erosion, chronic pain, infection, organ perforations and other complications stemming from implants manufactured by the Johnson & Johnson subsidiary. A recent court order indicates that the first bellwether trials in this litigation have been slated to begin on August 19, 2014, and will involve Gynecare Prolift devices. Bard Inc., American Medical Systems, Boston Scientific Corp., Ethicon, and other companies are now pending in separate federal proceedings established in the Southern District of West Virginia. Mr. Grand is currently a member of the Plaintiffs’ Steering Committee in the litigations involving C.R. Bard, American Medical Systems and Boston Scientific.
Thousands of Ethicon Gynecare mesh lawsuits have also been consolidated in a multicounty litigation currently underway in New Jersey’s Atlantic County Superior Court. According to a recent Case List posted on the court’s website, a total of 4,421 cases had been filed at this location as of September 23rd. Mr. Grand is serving as Co-Liaison Counsel in this proceeding, which concluded its first trial in March with an $11 million damage award to a woman who sustained injuries caused by Ethicon’s Gynecare Prolift device.
