Transvaginal Mesh Lawsuit: New Order Schedules Conference, Meetings in Federal Pelvic Mesh Litigations

Vaginal Mesh Litigations
Court records indicate that more than 75,000 vaginal mesh lawsuits are currently pending in the multidistrict litigations underway in the Southern District of West Virginia, where all federally-filed product liability lawsuits involving the defendants’ pelvic mesh implants have been consolidated to allow for coordinated pretrial proceedings. According to court documents, all of the cases pending in the Southern District of West Virginia were filed on behalf of women who allegedly suffered chronic pain, organ damage and other serious complications following implantation of surgical mesh products used to treat pelvic organ prolapse and stress urinary incontinence. Among other things, the lawsuits point out that the devices were the subject of a U.S. Food & Drug Administration Safety Alert in July 2011 which detailed serious complications associated with transvaginal mesh, and emphasized that the occurrence of such complications was not rare among women implanted with the devices to repair pelvic organ prolapse.
Since then, court records show that thousands of women have filed transvaginal mesh lawsuits in courts around the country. In addition to the federal proceedings established in West Virginia, more than 9,000 claims have been filed against Ethicon and C.R. Bard in two multicounty litigations underway in New Jersey’s Bergen County Superior Court, where Mr. Grand is currently serving as Co-Liaison Counsel. He also served on the plaintiff’s trial team for New Jersey’s first Ethicon mesh trial, which concluded in March 2013 after the jury awarded more than $11 million in compensatory and punitive damages to a woman who was injured by the Gynecare Prolift device.
