Transvaginal Mesh Lawsuit News: Almost 5,000 Cases Filed in New Jersey, Rottenstein Law Group LLP Reports
(PRWEB) July 24, 2013 -- Transvaginal mesh injury lawsuits consolidated in New Jersey are moving along, reports the Rottenstein Law Group LLP, a mesh law firm. There are currently more than 4,000 claims against manufacturer Johnson & Johnson Ethicon and more than 800 against CR Bard over each company’s pelvic mesh products, according to court documents in In re: Pelvic Mesh Litigation-Bard (6339-10) and in In re: Pelvic Mesh-Gynecare (6341-10).
The consolidation of New Jersey cases in Superior Court in Atlantic County, called a “multicounty litigation,” is designed to allow pretrial proceedings to be efficient and cost-effective while still providing each plaintiff with the potential for a case to go to trial and receive his or her own damages award, said Rochelle Rottenstein, principal of the Rottenstein Law Group.
“This is not a class action,” Rottenstein said. “An MCL, like a federal multidistrict litigation, can be an important development for numerous lawsuits that share a common cause and defendant.”
Women who have filed vaginal mesh lawsuits allege that the devices have caused them several serious adverse side effects since implantation, including vaginal erosion. The mesh is used to treat pelvic organ prolapse and stress urinary incontinence.
Several mesh manufacturers are also defendants in several thousands of federal lawsuits consolidated for pretrial efficiency.* Recent vaginal mesh awards included a 2012 verdict in California against Bard which resulted in a $5.5 million damages award** to the plaintiff and a 2013 verdict against Ethicon that resulted in an $11 million award*** to a woman who alleged serious injury from her implant.
