Transvaginal Mesh Lawsuit News: Bernstein Liebhard LLP Notes Issuance of New Order Pertaining to Discovery in Federal Boston Scientific Litigation

According to a Pretrial Order dated December 19, 2014, the Court has established schedules for two “waves” of discovery in the proceeding, with each wave consisting of 100 cases. The parties have each been directed to select 50 cases for each wave, with the selections for the first wave due by January 21, 2014. Vaginal Mesh Lawsuits
According to court documents, Boston Scientific is named a defendant in more than 8,000 vaginal mesh lawsuits that are pending in the multidistrict litigation underway in West Virginia. All of these lawsuits allege that pelvic mesh products marketed by the company to treat pelvic organ prolapse and stress urinary incontinence were defectively designed and manufactured, and caused recipients to suffer serious vaginal mesh complications, including mesh erosion and shrinkage, pain, infections, scarring and organ damage.
According to the December 19th Order, the first bellwether trial involving a transvaginal mesh lawsuit selected for the first wave of discovery in the Boston Scientific litigation is scheduled to begin in October 2014. The first trial involving a claim selected from the pool of cases for the second wave will begin in May 2015.
Boston Scientific is just one of several pelvic mesh manufacturers involved in litigations now underway in the Southern District of West Virginia. Bernstein Liebhard LLP partner, Jeffrey S. According to court documents, at least 40,000 claims have been filed in the proceedings pending in the jurisdiction.

Bard and Ethicon that are currently underway in New Jersey’s Atlantic County Superior Court.
