Bard, Inc. to vacate the $2 million verdict awarded to the Plaintiff in the first federal trial of an Avaulta vaginal mesh lawsuit. According to an Order filed in U.S. District Court, Southern District of West Virginia on October 18, 2013, U.S. District Judge Joseph R. Goodwin determined that the evidence submitted at trial was sufficient to allow a reasonable jury to conclude the Avaulta Plus pelvic mesh device the Plaintiff received in 2009 was defectively designed, and that C.R. Vaginal Mesh Lawsuits
According to court documents, C.R. Bard is facing more than 5,000 transvaginal mesh lawsuits in the Southern District of West Virginia, all of which allege its Avaulta products caused women to suffer painful vaginal mesh complications, including mesh erosion, chronic pain, infection, and scarring. Pelvic Repair System Products Liability Litigation, MDL No. 2187) The Plaintiff at the center of its first bellwether trial, which concluded in August, was forced to undergo multiple corrective procedures after she began suffering pain, bleeding and bladder spasms. Among other things, she alleged that C.R. Bard used a certain type of plastic resin in its Avaulta products, despite knowing it was not meant for permanent implantation in humans.
Court records indicate that the case was the second loss at trial for C.R. Bard. In July 2012, a California Superior Court jury ordered the company to pay $3.6 million of a $.5.5 million judgment after it determined C.R. Bard was partly responsible for vaginal mesh complications suffered by another Avaulta Plus recipient. The woman’s surgeon was found liable for the remainder of the judgment. (Scott v. The federal C.R. Bard litigation is just one of six consolidated proceedings underway in the Southern District of West Virginia for transvaginal mesh lawsuits.
