Transvaginal Mesh Lawsuit News: Carey Danis & Lowe Remarks on Bellwether Case Selection in West Virginia American Medical Systems Multidistrict Litigation

In pretrial order #71,* U.S. District Judge Joseph R. Goodwin selected four transvaginal mesh lawsuits to be bellwether cases, with the first of these lawsuits scheduled to go to trial as early as December 2013.

As detailed in the pretrial order, Judge Goodwin has not yet determined which of these four cases will go to trial first, but will be making that decision in the near future. Following the December trial, the next American Medical Systems bellwether case will go to trial in May 2014.
In the pretrial order, Judge Goodwin also set a time line for when the first transvaginal mesh lawsuit involving a plaintiff with pelvic organ prolapse (POP) will go to trial. The POP bellwether case is currently scheduled to go to trial in the third round of the bellwether process in July 2014.
The American Medical Systems MDL is being heard in the U.S. District Court for the Southern District of West Virginia and the litigation is known as In Re: American Medical Systems, Inc., Pelvic Repair Systems Product Liability Litigation MDL No. 2325.
