Transvaginal Mesh Lawsuit News: Federal Judge Denies Summary Judgment in Boston Scientific Vaginal Mesh Lawsuit, Bernstein Liebhard LLP Reports

filed against Boston Scientific Corp. continue to move forward in a multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to an Order dated January 17, 2014, the judge overseeing the proceeding has denied a request by Boston Scientific Corp. for a summary judgment in a case filed by a woman who received the Pinnacle Pelvic Floor Repair Kit and Advantage Transvaginal Mid-Urethal Sling System. In seeking the summary judgment, the company had argued that the vaginal mesh lawsuit is time-barred by California’s two-year statute of limitations because the Plaintiff had discovered the cause of her injuries more than two years before her claim was filed. However, U.S. District Judge Joseph Goodwin found that there was an issue of fact as to whether she could have discovered a connection between her vaginal mesh complications and her implant within that time frame. Vaginal Mesh Lawsuits
According to court documents, Boston Scientific is named a defendant in more than 8,600 vaginal mesh lawsuits now pending in the Southern District of West Virginia. All of the complaints claim that use of the company’s pelvic mesh products in surgeries to treat pelvic organ prolapse and stress urinary incontinence caused plaintiffs to suffer serious and debilitating injuries. The lawsuits further allege that that the company failed to provide adequate warnings to patients and doctors regarding the risk of serious vaginal mesh complications associated with its products. Court documents indicate that the first bellwether trial in the federal Boston Scientific litigation is scheduled to begin on March 10, 2014. Boston Scientific is just one of several pelvic mesh manufacturers involved in litigations now underway in the Southern District of West Virginia. Bernstein Liebhard LLP partner, Jeffrey S. He was also a member of the trial team on the first Ethicon trial, which ended in March with an $11 million verdict for the Plaintiff.
